Complaints and Dispute Resolution
If you are dissatisfied with our work or wish to make a complaint, please initially raise it with the partner responsible for the work. Should your complaint concern that partner, or remain unresolved after discussion, you should contact our managing partner. We are committed to addressing any complaint promptly. If your complaint remains unresolved, the firm is regulated by the Legal Services Regulatory Authority, which operates its own complaints procedure for the firms it regulates.
Dispute Resolution
For any disputes arising out of our Terms of Business or our retainer (excluding disputes about the amount or payment of our fees), we will first attempt to resolve the issue through mediation in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure. The mediation will take place in Dublin, Ireland, and be conducted in English. The mediator will be agreed upon by the parties, or if no agreement is reached within 28 days, nominated by the President of the Law Society of Ireland.
If mediation is unsuccessful, any dispute will be referred to arbitration by a sole arbitrator. The arbitrator will be appointed by agreement, or in default of agreement within 28 days of our election to refer the dispute to arbitration, by the President of the Law Society of Ireland. Arbitration will take place in Dublin and be private and confidential, conducted in accordance with the UNCITRAL Arbitration Rules in force at the time the dispute is notified, unless otherwise agreed.
Invoice Queries
For any queries about an invoice, please contact the relevant partner. If you wish to dispute an invoice, you must notify us in writing within 21 days of receiving the invoice, detailing the nature of the dispute. We will strive to resolve any invoice dispute informally, including through mediation if necessary. Additionally, you may refer any such dispute to mediation or make an application to the Office of the Legal Costs Adjudicators for adjudication of legal costs.
